Paul, "The Public Trust Doctrine: Who Has the Burden of Proof," paper presented at the July, 1996 Meeting in Honolulu, Hawaii of the Western Association of Wildlife and Fisheries Administrators, Hosted by the State of Hawaii Department of Land and Natural Resources. Describes the state's affirmative duty to protect our common heritage of air, water, soil, and wildlife and shows that the precautionary principle is intrinsic to the "public trust doctrine."
